The topic has been assigned to us was Fundamental Liberties. I now have a better understanding towards the liberties as a citizen has and how it actually plays an important role when any issue occurs. Yet, our fundamental liberties seem to be void when proclamation of emergency occurs because any court of law cannot question Yang di-Pertuan Agong issuing any proclamation. So, this shows that our liberties are only up to certain extend.
The issue that has interested me was the case Susie Teoh; Teoh Eng Huat v Kadhi of Pasir Mas Kelantan & Majlis Ugama Islam Dan Adat Istiadat Melayu, Kelantan. A 17 years old girl has converted her religion into Islam without her father’s consent. When it is brought up to court, a judge pointed out that the definition of guardianship only provides food, shelter, warmth and clothing, where the word “Religion” is not included. And it is supported by Article 11 (1): Every person has the right to profess and practice his religion and, subject to Clause (4), to propagate it. So the father had lost the case. After that, the father had appealed to high court again, and the judge said that the guardianship has the power to decide the religion of their children. At that time, Susie Teoh had turned into 21 years old which is age of majority. So the case ended up by saying that she can choose which religion based on her own will. The twist of this case is really interesting to me as how the judges had made their decision and how the age of majority actually affected the decision in high court.
The Q&A section in class was really helpful and it actually created competiveness between classmates to get the correct answer. It is another form of motivation and I also learnt a lot and enjoyed the activity at the same time.
The Taylor’s Graduate Capability that I have developed in myself is interpersonal skill, to co-operate with teammates and communicate to achieve what we wanted. Besides, I also develop some digital literacy skills, able to use wix.com to do work. Most importantly, I am able to apply theories into practice as we do our research work, which is discipline specific knowledge skill.
In a nut shell, I would like to thank to our lecturer Mrs. Saratha to give us advice in assignment and the contents in lectures are informative. And I also learnt that the importance of Federal Constitution to maintain the peacefulness in a country and protect person’s rights.
